Terms and Conditions
- Booking Fee.
- By booking with Emma Potts Photography you are entering into a contract and have therefore agreed to abide by the terms and conditions.
- Booking fees taken for any form of session are non refundable except in the event that Emma Potts Photography cancels the booking or for circumstances agreed with Emma Potts Photography.
2. Online Images & Galleries
- It is illegal to attempt to download, or to attempt to remove a watermark from, any image taken and posted online by Emma Potts Photography. Should an image online be saved via any means, and used elsewhere without the written permission of Emma Potts Photography, whether the copyright has been removed or not, a copyright infringement fee of £1000 per image will be applied to avoid court action, and must be paid within 28 days.
- If an online gallery is used, the gallery will be live for 5 days from the link being sent to the Client unless specified otherwise. If an order is not placed within that timeframe Emma Potts Photography reserves the right to ask for a £10.00 Administration fee to re-open the gallery for 24 hours. Any subsequent re-openings will be charged at £25.00 per week.
3. Fulfilment of Obligations
- Emma Potts Photography shall not be liable to the Client for any failure, in whole or in part, to fulfil its obligations where failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury.
- The Client understands and accepts that the photographic coverage will be as Emma Potts Photography professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes.
- In the unlikely event of total photographic failure or cancellation of the contract by either party or in any other circumstances the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential losses.
- If Client is more than 30 minutes late for a session without communication and agreement on reasoning the session is cancelled. A full session fee will need to be paid to rebook.
4. Cake Smashes
- It is the clients’ responsibility to inform Emma Potts Photography of any food allergy or intolerances the clients’ baby has prior to ordering the cake as outlined in the pre session information that you will receive. Emma Potts Photography will not be held liable for any adverse effect or illness the baby may suffer as a result of an allergy if the Client did not inform Emma Potts Photography.
5. Prints
- All images provided by Emma Potts Photography have been edited and shown at your viewing session on a calibrated monitor. Emma Potts Photography will not be held responsible for any variations in image quality caused by clients viewing their images on non-calibrated monitors
- Prints supplied by Emma Potts Photography are of high quality and standard and have been printed using professional equipment. Emma Potts Photography will not be held responsible for the quality of images printed by other means.
6. Final Gallery
- Emma Potts Photography aims to give you a wide variety of images to choose from at your viewing session however, there is no guarantee that any particular number of images can be created.
7. Image production
- In the event of uncooperative children at a session, resulting in less images than planned being produced, Emma Potts Photography can not be held responsible. All parents/guardians are responsible for children throughout sessions and must be present at all times.
- Emma Potts Photography fully edits all images before presenting to Client. Additional edits are carried out at the discretion of Emma Potts Photography, and Emma Potts Photography reserves the right to charge the Client for additional editing to cover time involved, at a rate of £15 per image. Any additional edit requests MUST be raised by Client at the viewing session or after viewing their online gallery. Any requests not given at this time will not be considered.
- lf the client does not view or purchase images within three months of the session without arrangement, Emma Potts Photography will assume they are not wanted and will delete all files.
- Emma Potts Photography has the right to its own judgement regarding the style and artistic input in the production of images. This includes but is not limited to poses, props and number of images taken. Due the willingness of subjects it may not be possible to capture all the pictures requested, or images to the client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, Emma Potts Photography may not be able to capture any, or all the images the Client may have requested or expected.
8. Camera Policy
- Cameras, camera phones, camcorders or any other recording equipment are NOT permitted during any session, without the permission of Emma Potts Photography.
9. Cancellation/Rescheduling
- A session date is not secured until the booking fee/deposit has been paid and received by Emma Potts Photography.
- You should give us as much notice as possible if you wish to reschedule your session date. Occasionally, we may need to reschedule (for example, weather conditions and events outside our control) and, in such an event, we will give you as much notice as possible. We will use reasonable endeavours to reschedule to a date that suits you, but cannot promise that an appropriate date will be available.
- You may reschedule once at no cost to you, after which you must pay a fee equal to 50% of the session fee each you time you wish to further change the date.
- Rescheduled sessions may not be cancelled.
- If you, or your child are unwell, please let us know in good time so we can arrange to reschedule your session for a later date.
10. Storing and Archiving
- Your images may be deleted/destroyed at the discretion of Emma Potts Photography after your images/order has been received unless specified otherwise.
- Emma Potts Photography is able to archive images for a longer period subject to payment of a storage fee we require.
11. Family and friends during sessions
- The studio has limited space so we ask that a maximum of 2 adults attend the session.
12. COVID-19
- All bookings made from 23rd of March 2020 onwards are subject to change due to government guidelines regarding COVID-19. Should your session be unable to go ahead, it will be swapped for an age appropriate session of equal value as soon as it is safe to do this.
- Every safety precaution is being carried out to minimise risk however by placing a booking the Client accepts that Emma Potts Photography will not be held responsible for any infection of COVID-19 after Clients session of any kind.
- Please only attend the session if you are feeling well. If you or anyone you have been in contact with has COVID-19 symptoms please let me know and we can reschedule your session.
